Notification on publication of the draft resolution of the Cabinet of Ministers of Ukraine "On Amendments to the Requirements for Providers of Electronic Identification and Electronic Trust Services"
The Ministry of Digital Transformation submits for public discussion the draft resolution of the Cabinet of Ministers of Ukraine "On Amendments to the Requirements for Providers of Electronic Identification and Electronic Trust Services" (hereinafter – the Requirements), developed to ensure the cyber resilience of the state and the continuous provision of qualified electronic trust services by transitioning to modern national standards of cryptographic information protection.
The draft act proposes to state paragraph 105 of the Requirements in a new wording, stipulating that the use of the cryptographic algorithm under DSTU 4145-2002 in the means of a qualified electronic signature is carried out using a hash function in accordance with DSTU 7564:2014 "Information Technology. Cryptographic data security. Hash function" ("Kupyna") and a symmetric block transformation algorithm in accordance with DSTU 7624:2014, while the use of other cryptographic digital signature algorithms is carried in accordance with the provisions of DSTU ETSI TS 119 312:2022.
These changes ensure the transition of qualified electronic trust service providers and the central certification authority to more crypto-resistant national standards used for the generation of qualified public key certificates and long-term protection of digital data, due to the cancellation of the hash function under GOST 34.311-95 starting January 1, 2026.
In addition, the draft act proposes to add paragraph 27 of the Requirements with a provision according to which the regulatory procedures of QTSPs shall determine the procedure for shortening and entering into the qualified electronic signature or seal certificate the data regarding the surname, first name, and patronymic of the user of electronic trust services, the total length of which exceeds 64 characters. The draft act also provides for the exclusion of certain provisions that have lost their relevance (the nineteenth paragraph of paragraph 102 and paragraph 87 of the annex to the Requirements). The changes are being introduced in accordance with the Law of Ukraine "On Electronic Identification and Electronic Trust Services" and the Resolution of the Cabinet of Ministers of Ukraine No. 764 of June 28, 2024.
